Terms and Guidelines
Payment Terms:
Booking Deposit & Cancellation: A non-refundable deposit is required to secure your booking date and time. This deposit is forfeited in full if the Client cancels the booking at any time, for any reason, as it compensates for reserving the date.
Rescheduling Fee:
Clients may request one (1) reschedule without penalty if the request is made in writing at least 48 hours before the scheduled shoot and subject to the Photographer's availability.
Any subsequent rescheduling requested by the Client will incur a fee of €50 and is subject to availability.
Rescheduling requests made less than 48 hours before the shoot may be treated as a cancellation at the Photographer's discretion, resulting in deposit forfeiture.
(Note: Weather-related rescheduling initiated by the Photographer follows different rules - see separate clause if applicable).
Remaining Balance: The remaining balance is due on the day of the photoshoot or event. Final products will not be delivered until full payment is received.
Travel and Parking Costs: Travel costs apply outside Tilburg (€0.35/km from 5045LG). Client is responsible for all parking fees and any applicable tolls, which will be added to the final invoice.
Payment Methods: Specify acceptable payment methods (e.g., Bank Transfer, Payment link, Cash)
Timely Communication:
Details Provision: Please provide all necessary details of the shoot, including location (unless the Photographer is the one to choose it) and date, as early as possible.
Schedule Changes: Inform us promptly of any delays or schedule changes. A 10-minute delay is acceptable, but any delay beyond this may result in a reduction of shoot time or additional charges.
File Handling:
Raw Files: The final product delivered to the Client consists of high-resolution, edited JPEG images. RAW files are the unedited, proprietary working files of the Photographer and reflect only part of the creative process. Therefore, RAW files are not included in any standard package and are generally not provided.
Image Selection: The Photographer will provide initially edited proofs (with signature color grading and basic adjustments) in a private online gallery. The Client must select their final images (the number included in their package) from this gallery within 7 days of receiving access. Final minor touch-ups will only be applied to these selected images.
Purchasing Additional Edited Images: Clients receive the quantity of edited images included in their chosen package. Should you wish to have more, additional edited images can be selected and purchased from the proof gallery beyond your package allowance.
Image Storage: All photographs will be stored for up to one year after the final product has been delivered. After this period, all files related to the project may be deleted.
Copyright and Usage:
Copyright: All images are protected by copyright and cannot be used for commercial purposes without the photographer's permission.
Commercial Use: Clients may not sell or distribute the images to commercial third parties without written consent from the photographer.
Credit/Attribution: Require clients to credit "IProtasewicz Photography" when sharing images online (e.g., on social media).
The Photographer may use selected images for portfolio display, marketing, competitions, and similar professional purposes.
Editing Style:
Client acknowledges viewing the Photographer's portfolio and agrees that edits will be consistent with the current artistic style. Major stylistic changes differing from the Photographer's established work cannot be accommodated.
Extensive Edits&Retouch: My photography style emphasizes natural beauty, so standard editing does not include extensive retouching like body modifications or major object removal. If you require such specific adjustments, these can be requested but fall outside standard service and will be quoted and charged additionally based on the complexity of the request.
Model Release:
Permission: Clients grant the photographer the right to use the images for her portfolio, promotional purposes, competitions, and similar professional purposes. This is an essential part of the photography business.
Session Conduct:
Respectful Behaviour: Clients are expected to behave respectfully and professionally during the photoshoot. Any inappropriate behaviour may result in the termination of the session without a refund.
Client Responsibility & Safety: The Client is fully responsible for the conduct, safety, and supervision of all persons accompanying them to the photoshoot, including children and pets. The Client assumes liability for their own safety and the safety of their party during the session.
Cancellation and Rescheduling:
Cancellation Policy: Cancellations made less than 48 hours before the scheduled shoot will result in the forfeiture of the deposit.
Rescheduling: Clients may reschedule their shoot once without penalty, provided they give at least 48 hours' notice (this doesn't apply to the weather conditions or a mutual agreement that rescheduling is necessary). Exceptional situations of rescheduling more than once will be considered.
Photographer Cancellation or Inability to Perform: In the highly unlikely event that the Photographer is unable to perform this Agreement due to illness, emergency, equipment failure, or other unforeseen circumstances beyond their control, the Photographer will make reasonable effort to secure a replacement photographer who is acceptable to the Client. If a suitable replacement cannot be found, the Photographer's liability shall be strictly limited to a full refund of all payments received from the Client for this specific session, including the non-refundable deposit.
Weather and Location Changes:
Weather Rescheduling Clause): If the Photographer must reschedule due to adverse weather, both parties will seek a mutually agreeable new date. If a new date cannot be scheduled within 60 days of the original date due to the Client's availability limitations, the non-refundable deposit becomes a credit valid for a future booking within 6 months of the original session date.
Location Permissions: If the Client chooses the photoshoot location(s), the Client is solely responsible for obtaining all necessary permissions or permits and covering any associated location fees or costs required for access and photography. These must be secured and paid prior to the scheduled shoot date.
Product Delivery:
Turnaround Time: I understand you're eager to receive your images! To ensure dedicated attention and high quality for every client, all photoshoots and events are carefully edited in the order they were photographed. While I always strive for efficiency, please allow approximately 2-4 weeks from your session date for the delivery of your final edited gallery. This timeframe can vary slightly depending on the current workload and seasonality.
Rush editing: If you require your photos to be delivered sooner than the standard editing time, a rush editing fee will apply. The fee depends on how quickly the images are needed and the number of photos that need to be edited. The additional cost for rush editing ranges from €50 to €200.
Delivery Method: Images will be delivered digitally through an elegant online gallery and if included in the package - prints sent by mail as agreed upon during the booking. The gallery will remain active for viewing and downloading for 30 days from the date it is made available to the Client.
General Legal Clauses:
Limitation of Liability: The Photographer's total liability related to this Agreement is limited to the amount paid by the Client hereunder. The Photographer is not liable for indirect or consequential damages.
Indemnification: Client agrees to indemnify and hold harmless the Photographer against all claims, costs, and damages arising from Client's (or their party's) actions during the shoot, breach of this Agreement, or misuse of images.
Force Majeure: Neither party is liable for non-performance caused by events beyond reasonable control (e.g., natural disaster, pandemic, government order). If such events prevent the shoot, parties will attempt to reschedule; if impossible, Photographer will refund payments made.
Governing Law: This Agreement is governed by the laws of the Netherlands.
Dispute Resolution: Disputes shall first be addressed through amicable negotiation. If unresolved, the competent court in the Netherlands has exclusive jurisdiction.
Severability: If any part of this Agreement is found invalid, the remaining parts stay in effect.
These rules are designed to ensure a smooth and enjoyable experience for everyone involved. By booking a photoshoot with IProtasewicz Photography, clients agree to abide by these terms and conditions.
